Proposed terms of use.

This proposed draft for Tare is pending legal counsel review and approval. It is published for review only, is not an approved public policy and is not currently in force. Tare is operated by SSPC HOLDINGS PTY LTD (ACN 655 413 273, ABN 85 655 413 273).

1. Acceptance.

If this draft is approved and brought into effect, by accessing or using Tare, you will agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility and accounts.

You must be at least 18 years old. The App is not available to anyone under 18. You must provide accurate account information and keep your credentials secure.

You are responsible for activity under your account. Tell us promptly at support@tare.net.au if you believe your account has been compromised.

3. What Tare does.

Tare collects publicly available product pricing from Australian retailer websites (Coles, Woolworths, Aldi, IGA, and similar) and presents it alongside available historical context. Where evidence supports it, we compute a product verdict (BUY NOW / OK / WAIT / OVERPRICED). Price-history coverage varies by product and retailer and may include up to twelve months.

Tare is informational. We don't sell groceries. We don't transact on your behalf. We don't guarantee in-store availability or that the prices we show exactly match in-store tags at the moment you check out.

4. Pricing, availability and advice.

Prices, promotions, product details, stock and availability can change at any time and may vary by store or location. Data sources can be delayed, incomplete or wrong. Tare shows source and last-updated information where available, but the retailer's current shelf, app or checkout price is authoritative.

Verify important details directly with the retailer before purchase. Tare provides informational shopping guidance and historical context, not a price guarantee or financial, medical or other professional advice.

5. No retailer affiliation.

Tare is not affiliated with Coles, Woolworths, Aldi, IGA, or any other retailer named on the service. References are descriptive, not endorsements.

6. Acceptable use.

Tare grants you a limited, revocable, non-transferable right to use the App for personal, non-commercial shopping decisions under these Terms.

You must not use Tare unlawfully or to harm others; attempt unauthorised access; disrupt the service; introduce malicious code; reverse engineer the App except where law permits; scrape beyond expressly permitted limits; commercially redistribute Tare data; misuse another person's data; or infringe third-party rights.

We may investigate suspected misuse and suspend or terminate access where reasonably necessary.

7. User content.

If you submit content (for example, reviews, notes or uploads), you grant us a non-exclusive, worldwide, royalty-free licence to host, process, display and use that content for operating and improving Tare. You warrant that you have the rights to submit it and that it does not violate laws or third-party rights.

8. Intellectual property.

Tare, its software, design, original content and branding are owned by us or our licensors and protected by intellectual-property law. Retailer names, logos, product images and other third-party content remain the property of their respective owners. No rights are granted except the limited right to use Tare under these Terms.

9. Third-party services and links.

Tare relies on or links to third-party services, including retailers, identity providers, cloud and database providers, AI, speech recognition, maps and geocoding, app stores and payment providers. Their own terms and privacy policies may apply. We are not responsible for third-party services we do not control.

10. Closed beta, subscriptions and refunds.

No paid features are offered during the 18+ invite-only closed beta. Beta access may be limited, changed or withdrawn while we test the service.

If paid features are introduced, the purchase screen will show the price, billing period, renewal terms, trial terms, taxes where applicable and how to cancel before you buy. Future pricing has not been set.

Subscriptions purchased through Apple or Google must be managed and cancelled through the relevant app-store account. Deleting Tare or your Tare account does not automatically cancel a store subscription. Cancelling stops future renewals but does not automatically refund a completed billing period unless required by law or approved by the store.

Refund requests are handled through the relevant app-store process, these Terms and rights that cannot be excluded under the Australian Consumer Law. Tare support remains available at support@tare.net.au.

11. Service changes and availability.

We may add, change, suspend or discontinue features. We do not promise uninterrupted, secure or error-free operation, and beta features may be incomplete or unavailable. We will take reasonable care but cannot guarantee that data will never be lost or that every feature will remain available.

12. Warranties and Australian Consumer Law.

To the maximum extent permitted by law, Tare is provided "as is" and "as available" without warranties beyond those that cannot lawfully be excluded.

Our services may come with consumer guarantees under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any non-excludable consumer guarantee, right or remedy. If a guarantee applies and is not met, you may be entitled to the remedy required by law.

Where the law permits us to limit a remedy for breach of a non-excludable service guarantee, our liability is limited to supplying the service again or paying the reasonable cost of having it supplied again.

13. Limitation of liability.

Subject to non-excludable rights and to the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or loss of profits, data, goodwill or opportunity, arising from Tare, third-party data or reliance on a price insight or verdict.

To the extent a cap is permitted, our aggregate liability for claims relating to Tare is limited to the greater of AUD $100 or the amount you paid us for Tare in the 12 months before the claim.

14. Indemnity.

You indemnify SSPC HOLDINGS PTY LTD and its officers, employees and agents against losses, liabilities and costs (including reasonable legal costs) arising from your breach of these Terms, misuse of Tare or infringement of third-party rights.

15. Suspension and termination.

You may stop using Tare at any time and may request account deletion. We may suspend or terminate access where reasonably necessary for security, legal compliance, service protection or a material breach of these Terms. Where practical and lawful, we will give notice and a reasonable opportunity to address the issue.

16. Privacy.

Our Privacy Policy explains how we collect, use, disclose, retain and protect personal information, including data processed by account, geocoding, speech-recognition and AI providers.

17. Complaints and disputes.

Contact support@tare.net.au first. We will try to resolve complaints promptly and in good faith. Nothing here prevents you from exercising a right or remedy available under applicable consumer or privacy law.

18. Governing law.

These Terms are governed by the laws of Australia and Victoria. Courts in Victoria have non-exclusive jurisdiction, subject to any mandatory consumer protection or right to bring a claim elsewhere.

19. Changes to these Terms.

If an approved version takes effect, we may update it from time to time. Material changes will be notified in the App, by email or on this website. The version and date at the top will identify the Terms presented for acceptance. Continued use after updated Terms take effect means you accept them.
